Overview

The Bronx Defenders – an innovative, progressive, holistic indigent defense office in the South Bronx – seeks an energetic, experienced attorney with a commitment to public defense to join our Criminal Defense Practice as a DNA Specialist Staff Attorney.

 

Criminal Defense Attorneys at The Bronx Defenders zealously advocate for individuals charged with misdemeanor and felony offenses in the Bronx Criminal Courts. They appear in various proceedings including but not limited to arraignments, hearings and trials in criminal courts, as well as concurrent proceedings such as Superintendent’s suspension and Department of Motor Vehicle refusal hearings.

 

Responsibilities

As a member of the Bronx Defenders’ Forensic Practice Group, the DNA Specialist will work with other staff attorneys—either via consultation or as co-counsel—to assist in the litigation of all cases where there is DNA evidence. Carrying a reduced caseload, the DNA Specialist will be expected to have (or work quickly to gain) an understanding of the science underlying DNA evidence in order to carry out the following responsibilities:

  • Train attorneys about the science of DNA  
  • Consult with attorneys regarding litigation strategy on cases with DNA evidence
  • Keep an ongoing tally of cases with DNA evidence, tracking the strategies taken in individual cases
  • Review forensic biology files and consult with attorneys about the data and conclusions contained therein
  • Meet with OCME criminalists (Office of Chief Medical Examiner, Department of Forensic Biology, lab that conducts DAN testing in NYC)
  • Prepare model motions for cases with DNA evidence
  • Litigate the admissibility of expert testimony on scientific technique and other areas of law pertaining to the use of DNA evidence
  • Become familiar with experts on DNA evidence
  • Assist with the preparation of cross-examinations of DNA experts
  • Attend and participate in trainings on DNA evidence both inside and outside the office

 

Qualifications

To qualify, applicants should have:

  • At least three years of experience as a criminal defense attorney (two years practice at The Bronx Defenders preferred, but not required)
  • Membership in good standing with the New York Bar or immediate eligibility to waive in
  • Background in forensic DNA evidence and/or statistical analysis preferred, but not required
  • Excellent research, writing and courtroom advocacy skills
  • Ability to think critically
  • Strong communication and interpersonal skills
  • Ability and desire to work collaboratively in interdisciplinary teams
  • Commitment to defending indigent individuals charged with criminal offenses
  • Experience and interest in working in and with marginalized communities
