The Bronx Defenders (BxD) – an innovative, progressive, holistic indigent defense office in the South Bronx – seeks an experienced attorney to fill a position as Director of the Impact Litigation Practice (ILP).   BxD is a public defender non-profit that is radically transforming how low-income people in the Bronx are represented in the legal system, and, in doing so, is transforming the system itself. BxD seeks thoughtful, creative, energetic individuals with a strong commitment to social justice to join our dynamic and diverse staff. Our staff of over 450 includes interdisciplinary teams made up of criminal, civil, immigration, and family defense attorneys, as well as social workers, benefits specialists, legal advocates, parent advocates, investigators, and team administrators, who collaborate to provide holistic advocacy to address the causes and consequences of legal system involvement. Through this integrated team-based structure, we have developed a groundbreaking, nationally recognized model of representation called holistic defense that achieves better outcomes for the people we defend.   Each year, we defend more than 20,000 low-income Bronx residents in criminal, civil, family regulation, and immigration cases, and reach thousands more through our community intake, youth mentoring, and outreach programs. Through impact litigation, policy advocacy, and community organizing, we push for systemic change at the local, state, and national levels. We take what we learn from the people we represent and communities that we work with and launch innovative initiatives designed to bring about real and lasting change.   Impact Litigation Practice   The Impact Litigation Practice (ILP) is a collaborative civil rights division of BxD that uses civil litigation strategies to advance and strengthen the rights of the people we represent. ILP works closely with direct services staff to identify widespread injustices affecting the people we represent and leverage civil legal tools—from demand letters to class action lawsuits—to redress and end those injustices. ILP’s work covers varied civil rights issues, including but not limited to racial and economic inequity, immigrant rights, LGBTQ rights, and fundamental freedoms. ILP’s approach to civil rights litigation—from the cases we choose to work on to the change we advance—is guided by engagement with the communities we work with, lessons learned in our direct services representation, and a commitment to supporting movements for BIPOC rights.   Some recent efforts include: - A state lawsuit against the NYPD for violating privacy laws on behalf of a class of millions of people with arrest records - A federal lawsuit that secured an order requiring ICE to bring detained immigrants before a judge soon after detaining them - A Freedom of Information Law request that brought to light a non-public report showing that the Administration of Children and Family Services (ACS) discriminated against Black and brown parents Coordinated pre-litigation claims on behalf of Black and brown protesters brutalized by the NYPD that resulted in over a million dollars in settlement offers

We take what we learn from the people we represent and communities that we work with and launch innovative initiatives designed to bring about real and lasting change.   The Criminal Defense Practice   The Criminal Defense Practice (CDP) at The Bronx Defenders consists of over 150 attorneys, investigators, social workers, practice associates, and administrators who provide comprehensive criminal defense representation to people in the Bronx facing police and criminal legal system involvement. Our interdisciplinary holistic teams work to identify and address issues that contribute to the ensnarement of the people we represent in the criminal legal system and mitigate the enmeshed consequences that arise out of their contact with the system. Through a client-centered approach, our CDP legal teams strive to gain a deeper understanding of the circumstances and priorities of the people we represent. Equipped with that understanding, they fight for desired outcomes by strategically raising personalized, persuasive arguments in mitigation, negotiations, and litigation.    Homicide Practice Group The Bronx Defenders Homicide Practice Group (HPG) understands that the world of homicide defense is rapidly changing. The presentation of video evidence, DNA results, and cell phone location data means that it is no longer sufficient for homicide defenders to only know how to effectively cross-examine an experienced police detective. Juries today come into the courtroom with far different perceptions of forensics, criminality, and the criminal justice system than those of the past. Issues of gender, race, and ethnicity percolate through jurors’ minds in ways we are only beginning to understand. These ever-changing dynamics make it necessary for the Homicide Practice Group to be willing to grapple with these issues, be flexible in their approach to litigation and mentorship, and be committed to keeping up with the rapidly evolving landscape of public defense. The Homicide Practice Group is made up of a team of experienced CDP attorneys, social workers, mitigation specialists, and investigators who specialize in homicide cases. While it is a specific group of senior practitioners, HPG is committed to encouraging a wide range of attorneys with varying levels of litigation experience to become involved in homicide work.

Every youth receives the expertise of a trained adolescent defense attorney, social worker, and education attorney/advocate. Working together, they address the issues that drive the young people we represent into the criminal justice system, mitigate the consequences of their arrest, and provide our young people with holistic support, helping them navigate the education system, access mental health support, and attain future goals. As one of many specialized programs at BxD, ADP forms part of a larger interdisciplinary team that includes family defense attorneys, immigration attorneys, and civil legal advocates.   In addition to providing the youth we represent with zealous and holistic defense; the Adolescent Defense Practice also advocates for youth justice reform on the local and state levels and conducts best practices training for other youth defense attorneys in the region.

Our Immigration attorneys and advocates work closely with people ensnared in the immigration legal system throughout the pendency of their cases in both Criminal and Family Court to avoid and mitigate negative immigration consequences that may arise from those cases. Our Immigration staff represent people in deportation proceedings in both detained and non-detained settings, provide affirmative immigration services, and pursue community-based litigation and advocacy aimed at transforming unforgiving anti-immigrant federal laws and policy. The Immigration Practice consists of approximately 60 staff members including attorneys, social workers, legal advocates, and administrators.      Since 2013, our immigration attorneys have also worked as assigned counsel at the Varick Street Immigration Court under the New York Immigrant Family Unity Project (NYIFUP), the first-ever universal representation project in immigration court.

Social Work interns receive a comprehensive orientation with an introduction to all of our interdisciplinary practice areas and special projects; technical skill training and simulations; and anti-oppression workshops. Our Social Work interns gain invaluable client interaction experience, participate in intensive legal& Social Work skills training series, and have the opportunity to advocate for clients in legal settings. Our Family Defense Practice is at the forefront of a movement to provide holistic representation to parents in the Bronx while creating long-term solutions for the reunification and stability of families. Family Defense Practice Attorneys primarily litigate abuse and neglect cases, but occasionally appear in concurrent matters including custody, visitation, and termination of parental rights.    Immigration Practice     Twenty years ago, The Bronx Defenders developed the model of integrated criminal defense and immigration representation. Our advocates have specialized expertise fighting on behalf of members of the LGBTQ community. Every day, low-income LGBTQ community members are at high and disproportionate risk of system involvement and victims to injustices as they navigate those systems. The LGBTQ Defense Project works creatively, zealously, and compassionately to ensure meaningful access to justice and secure better outcomes for the people we represent. We provide the support needed to establish stability in the lives of the people we represent, challenge ill treatment of LGBTQ people within the legal system, and help people seek redress for state-backed violence and discrimination.

Our Right to Counsel Housing Team was developed in response to the 2017 New York City Right-to-Counsel initiative, which provides tenants facing eviction in Housing Court, New York City Housing Authority (NYCHA) administrative proceedings and other civil fora with access to free legal representation. Our team works with civil social workers and benefits specialists to supplement their legal defenses and provide additional services, support and resources, committed to a Housing First perspective--an approach to homelessness that prioritizes providing permanent housing to people experiencing homelessness quickly, thus ending their homelessness and serving as a platform from which they can pursue personal goals and improve their quality of life. As a provider of the Right to Counsel in the Bronx, we regularly staff in-court intake. The Bronx Defenders is part of the NYC Right to Counsel Coalition.

The Immigration Practice consists of over fifty staff members including attorneys, social workers, legal advocates and administrative professionals.     Integrated Criminal Defense and Immigration Representation     Twenty years ago, The Bronx Defenders developed the model of integrated criminal defense and immigration representation. Our immigration attorneys and advocates work closely with people ensnared in the immigration legal system throughout the pendency of their cases in both Criminal and Family Court to avoid or mitigate negative immigration consequences.     The New York Immigrant Family Unity Project (NYIFUP)    Since 2013, our immigration advocates have served as assigned counsel at the Varick Street Immigration Court under the New York Immigrant Family Unity Project (NYIFUP), the first-ever universal representation project in immigration court.     Community Intake    In addition to representing people through NYIFUP and our arraignment process, the Bronx Defenders has a Community Intake Team which allows members of the Bronx community to walk into our office and proactively seek assistance with public benefits, as well as criminal, family, immigration, and civil legal issues. Community Intake Advocates from the Immigration Practice provide early intervention, assistance navigating legal systems, direct representation in affirmative and removal cases, and high-quality referrals for hundreds of community members each year. Intervention at this early stage helps people to avoid deportation proceedings.

We take what we learn from the people we defend and communities that we work with and launch innovative initiatives designed to bring about real and lasting change.    Family Defense Practice    The Bronx Defenders’ Family Defense Practice (FDP) provides legal representation and social work support to parents charged with child abuse and neglect, and who are at risk of losing custody of their children. Family Defense Attorneys at The Bronx Defenders are at the forefront of a movement to provide holistic, institutional representation to parents in Bronx County Family Court who are fighting allegations of child abuse and/or neglect. They are dedicated to fighting on behalf of parents whose parental rights are in peril while creating long-term solutions for the reunification and stability of families. Family Defense Attorneys primarily litigate abuse and neglect cases, but will occasionally appear in concurrent matters including custody, visitation, and termination of parental rights cases.
